"yesterday a vote in the US Senate fell four votes short of what was needed to restore habeas corpus — the fundamental right of individuls to challenge government detention. Here is the record of the vote on the Cloture Motion to restore Habeas Corpus. Article 4 of the US Constitution states that habeas corpus shall not be suspended unless in cases of rebellion and invasion when the public safety may require it."

Umm, wow.... I didn't even know it had been suspended..... This is scary.....

Interesting vote mostly along party lines. There were a few people there that I figured would have voted "Nay" but didn't and a couple that I thought would be "Yea" that weren't.

I knew that it had been suspended but a Wikipedia check states that it occurred on 11/13/01. It's particularly scary because

The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it.

I don't remember us being invaded or rebelling. It looks like the intent of the suspension is/was to deal with suspected terrorists (obviously), but legally it could be applied to anyone.

Wikipedia wrote:Habeas corpus is also used as a legal avenue to challenge other types of custody such as pretrial detention or detention by the United States Bureau of Immigration and Customs Enforcement pursuant to a deportation proceeding.

There's a lot of interesting information in the Wiki article, too much to go into detail here, and probably some of it biased in some way or another...

NOTICE: There is no free speech anymore. Just wanted you to know.

Paladin, can I have my nickel now?

It's kind of scary, but the Republican's use to be the party of less government. I do not think I like this swing.....

I agree with you on this issue Atomm. I am libertarian in a lot of my views because I like less government myself.
